2015 Senate Bill 507:
Effective January 1, 2017: Statewide issuance of vital records allows any Register of Deeds office in the State of Wisconsin to issue records of birth, death, marriage and divorce from all Wisconsin counties.
Not all vital records will be eligible for statewide issuance: some special service records are excluded. Records included for statewide issuance and dates are as follows:
· Birth records October 1, 1907 to present
· Death records September 1, 2013 to present
· Marriage records June 21, 2015 to present
· Divorce records January 1, 2016 to present
· Tribal marriage and divorce January 1, 2016 to present
All records that do not fall within the parameters above can be obtained by the County Register of Deeds where the event occurred or by the State Vital Records Office.
2015 Act 295 Real Estate Exemptions
Effective July 1, 2016 the following real estate transfer fee exemptions were modified: 77.25 (6) - pursuant to mergers of entities, 77.25(6d) pursuant to partnerships filing or canceling a statement of qualification, 77.25(6m) pursuant to the conversion of a business entity. This bill created two new exemptions: 77.25(6q) pursuant to an interest exchange under sec. 178.1131 and 77.25(6t) pursuant to a domestication under sec. 178.1151.
Wisconsin Department of Revenue Administrative Rule Change
Effective May 1, 2016 all Termination of Joint Tenancy Documents require a Wisconsin Real Estate Transfer Return form. Exemption 77.25(11) appropriate for HT110 and exemption 77.25(11m) appropriate for HT110-TOD non-probate transfer on death under s.705.15.
2015 Wisconsin Act 145 Real Estate Transfer Returns for Exempt Conveyances
Effective February 6, 2016 – requires the filing of real estate transfer returns for any conveyance of property, including those were there is no filing fee required, with the only exception from filing for conveyances dated prior to the creation of the real estate transfer fee law October 1, 1969. As amended, the bill also prohibits local fees from being imposed on conveyances that are exempt from the real estate transfer fee. This legislation affects conveyances drafted on or after February 6, 2016.
2015 Wisconsin Act 142 Publishing Vital Records
Effective February 6, 2016 – changes the way vital records are labeled and issued for events occurring before October 1, 1907. Under current law, Vital Record Offices may issue uncertified copies of vital records if they occurred before October 1, 1907, and the uncertified copy is labeled as uncertified and cannot be copied, made available to the public in an electronic format, or used for identification purposes. Under this bill, uncertified copies will no longer be labeled as uncertified, and are permitted to be copied or made available electronically. Uncertified copies still cannot be used for identification purposes.
2015 Wisconsin Acts 38 and 48 effective July 3, 2015
Blue ink is now allowed anywhere on real estate documents.
Original land contracts made on October 1, 1969 and thereafter will require a transfer return.
No longer have to check box 6 for UCC 1 filings.
