5.041 PUBLIC NOTICE OF ACCESS TO PUBLIC RECORDS

NOTICE IS HEREBY GIVEN, that except as otherwise provided by law, any requester has the right to inspect any record or document maintained by the Brown County Children with Disabilities Education Board (BCCDEB). Any requester has the right to make or receive a copy of a record which appears in written form. It is the policy of this office to provide copies of records to a requester for the amounts listed below. Prepayment of the fee may be required if the fee exceeds $5.00.

The legal custodian for this office is the Administrator of the BCCDEB. In the Administrator’s absence, the legal custodian is the Administrative Secretary. For records housed in other buildings (student records), request must be processed through this office and in addition, conform to the public access notice of the building in which they are housed.

Request to inspect public records may be made to the legal custodian during regular office hours: 8:30 A.M. to 11:30 A.M. and 12:30 P.M. to 3:30 P.M., Monday through Friday, except holidays.

The fee schedule for records maintained by this office is twenty cents ($.20) for each copy needed. Charges made of other governmental agencies shall be modified to coincide with that agency’s policy.

Certain records maintained by this office are exempt from the provision of 19.35 WI Stats. If the requester demands to inspect or copy such exempt records, the requester will be advised of the basis for the records exemption from the access law. If the requester objects to a denial of access, the requester may request the Corporation Counsel, Sixth Floor, Northern Bldg., Green Bay, WI to review the request for access.

PLEASE NOTE: ALL STUDENT RECORDS AND RECORDS THAT INDENTIFY STUDENTS WITH DISABILITIES ARE EXEMPT FROM THE PUBLIC ACCESS LAW AND SHALL BE GOVERNED BY SECTION 118.125 OF THE STATUTES, SECTION 438 OF TITLE V OF THE EDUCATION AMENDMENTS, AND BOARD POLICY 5.04. ALL PUPLIC RECORDS WILL BE HANDLED IN ACCORDANCE TO 2003 WISC ACT 292.
