Minor Guardianships

The following forms are necessary to begin a Minor Guardianship under Wis. Stats. 54:
  • Petition for Temporary/Permanent Guardianship (GN-3290)
  • Order and Notice of Hearing Petition for Guardianship of Minor (GN-3300) - if parents consent
  • Waiver and Consent to Petition for Guardianship of Minor (GN-3310)
  • Statement of Acts by Proposed Guardian and Consent to Serve as Guardian (GN-3140)
  • Order Appointing Guardian ad Litem (GF-131)
Once you have completed all of the necessary forms, bring them to the Register in Probate’s Office (Brown County Courthouse, 100 S. Jefferson Street, Room 160, Green Bay, WI 54301). A judge will be assigned to the case, and a hearing will be scheduled. You will also need to pay the following fees:
  • $4.00 made payable to the Brown County Register in Probate;
  • $500.00 Guardian ad Litem Deposit - may be waived if petitioner is indigent (Made payable to the Guardian ad Litem appointed by the court)
A copy of the Petition and Order and Notice of Hearing Petition for Guardianship of Minor must be mailed or served on the following individuals:
  • Mother of Minor
  • Father of Minor
  • Guardian ad Litem
  • Minor (if over 14 years old)
  • All other Interested Persons
Make sure that you make extra copies of each document you intend to provide to interested parties. We must charge you a copy fee of $1.00 per page - see Wis. Stats. 814.66(1)(h)

The Affidavit of Service (GN-3120) will need to be completed by you and filed with the Register in Probate office prior to the hearing. This Affidavit is your sworn statement to the court that copies of the required documents have been provided to everyone that is entitled to notice.

The following forms must be completed and brought to the scheduled guardianship hearing:
  • Nomination of Guardian by a Minor – 14 years and older (GN-3320) - to be completed in court by minor
  • Determination and Order on Petition for Guardianship of a Minor (GN-3330)
  • Letters of Guardianship of the Person of a Minor (GN-3340)
  • Letters of Guardianship of the Estate of a Minor (GN-3345)
The Guardianship Inventory (GN-3440) must also be completed 60 days after appointment as Guardian of the Estate of a Minor, and the proper filing fee paid. (420.00 or 0.2% of value of estate - whichever is greater.
